So I'm not one telling people my problems, but I feel everyone should know this because everyone we have talked to has said this can't happen.
So on December 23 we were renting a place here in red deer from a gentlemen for 6 months and on that day we got a letter in the mail from the courts saying our landlord hasn't payed his mortgage for 6 months and that we had to be out by January 19th because that was the date the courts granted the settlement
All our family and friends said they can just kick you out that they have to give you more time and can't kick little kids out in the middle of winter
Our lawyer even said all they have to do is give one months notice and that's it if your still in the house they you and your family will be taking out with force and your stuff is sold with the house
So january 15 th we were out of our place just to be safe and staying at a friends place till we can get a new place because from December to February is the worst time of year to look for rentals our realestaste agent has told us
So the reason I'm telling people this is because a lot of people think different things that the courts can do when the truth is all they have to do is just only give the 1 months notice and that's its
But we will be fine and will turn this around and be better from it
We just pray no family has to go through something like this and just want to educate so people are aware of what can happen

It is always sad to hear that such things occur in Canada too. Your right that there should be someone providing you with free legal advice to help you out better. And I'm betting that any free advice always paints it as helpless in your case with the use of "extenuating circumstances" as the defining reason as to why this doesn't work in your case. This is because the rule of you having rights relies on the aspect that is only if you can afford them.
Now if you had indeed stayed and then had video recording of them trying to make you move.....then throwing it up on YouTube and calling the local news stations. But this tactic would only have effect if they never completed their task due to you barricading yourself in, etc.
It's indeed too bad that only sensationalism such as that mentioned above would bring light to one's true rights as they are now shown to be. The fact that you still had others for support to prevent endangering your family is fortunate. Yet this same scenario will eventually happen to another that doesn't have any alternatives and then maybe others will finally take note when a father is fighting for his families rights to survive another day.
So maybe now renters should get to see proof from potential landlords that they are indeed paying their debts up to date before you move in? Maybe now they should have to pre-qualify too?
Yeah I looked into what a landlord has to tell you and it's nothing doesn't even have to say he's late on payments or talking to the bank all you get in the end is a court document saying get out
But on the plus side found a place in temple area of N.E Calgary just hoping family can help with some of the money but looks like calgary is new home for February lol anyone want to help move in when I know lol

I just happened to view a post on IPN a few minutes ago and decided to check the Alberta forum.
Wish I had checked in sooner with you after getting back into town, but I had been "under the weather" for the last two weeks of January and wasn't checking much email.
Hope you and the family get settled soon.
